The Four-Tier Risk Framework: Where Does Your AI Fit?

The AI Act introduces a four-tier risk framework that determines how strictly different AI applications will be regulated. With a two-year transition period starting in August 2024, compliance teams have some time to prepare—but waiting isn’t an option. If AI is part of your operations, now’s the time to assess where it falls within these categories.


Unacceptable Risk: AI That’s Strictly Prohibited

Some AI applications are outright banned because they pose serious threats to fundamental rights. This includes AI used for:

  • Cognitive behavioral manipulation
  • Emotional recognition in workplaces and schools
  • Social scoring (think China’s AI-driven surveillance system, where citizens are scored based on their behavior)

If your AI system falls into this category, there’s no way to make it compliant—it simply won’t be allowed under EU law.


High Risk: AI That Comes with Heavy Compliance Requirements

AI used in critical areas—such as financial services, hiring, and fraud detection—falls into this category. These systems are allowed but must meet strict regulatory requirements, including:

  • Governance and oversight: AI can’t operate unchecked; human supervision is required.
  • Rigorous data management: AI models must be trained on high-quality, unbiased data to prevent false positives or discriminatory outcomes.
  • Compliance with EU conformity assessments: Similar to financial regulations, AI must meet strict operational standards.

For compliance teams, this means documentation, risk assessments, and transparency audits will be essential. If your AI is helping to detect financial crime or assess customer risk, now’s the time to put robust governance structures in place.


Limited Risk: AI That Requires Transparency Measures

Some AI applications aren’t inherently risky but could still mislead users. This category includes:

  • Chatbots that interact with customers or employees
  • AI-generated synthetic content (like deepfakes)

Companies using AI in this way will need to disclose when users are interacting with an AI system. While this may seem like a minor requirement, failure to provide transparency could lead to regulatory issues—especially in fraud prevention, where AI-generated content is increasingly being used for scams.


Minimal Risk: AI That’s Unregulated (For Now)

If an AI system doesn’t fit into the above categories, it’s considered low risk and isn’t subject to specific AI Act regulations. But that doesn’t mean it’s risk-free. Regulations can evolve, and an AI tool that’s currently unregulated could become subject to stricter rules down the line. Compliance teams should document AI use cases and be prepared for future scrutiny.


Why Compliance Teams Need to Act Now

Two years may seem like a long runway, but compliance isn’t something you can fix overnight. To stay ahead of the AI Act, compliance teams should:

  • Map out existing AI use cases within their organization and determine their risk category.
  • Review governance frameworks to ensure AI oversight and accountability measures are in place.
  • Start documenting AI processes now to avoid scrambling when regulators start enforcing the rules.
